The history of food safety regulation has been a history of food safety crises and regulatory responses to those crises. (1) As that is the case, most literature concerned with what can be learned from a food safety crises focuses on the strengths and weaknesses of regulatory regimes. (2) This is because central to any crisis is the role of regulation in identifying, assessing, and managing risks. (3) Historically, regulators have primarily prevented the deliberate and grossly negligent contamination of food. (4) Increasingly, in the last forty years, food safety crises have involved more uncertain and complex health risks, risks that are socio-politically contentious and require considerable scientific resources for their assessment. (5) In such circumstances, the creation and operation of food safety regulation has largely been conceptualised as requiring a choice between whether the scientific and democratic inputs into decision-making should dominate. (6) Any particular crisis is understood as an example, for that commentator at least, of the wrong input dominating.
